How man who returned from abroad spent five months in prison custody after fighting with girlfriend

A man who returned from Australia last year and who had a fight with his girlfriend who reported him at the police station and was eventually arrested and charged to court has now regained his freedom after spending five months in prison custody.

The man, whose name was given simply as Mr Nice, is said to be a businessman residing in Australia but due to some crises faced by his business over there, he decided to return to Nigeria last year.

He however had a disagreement with his girlfriend in his residence in the Lekki area of Lagos State which led to a fight and the lady eventually reported him at the police station for allegedly threatening her life.

The policemen were said to have followed her to his house on April 3, 2022, where the man was arrested and he was eventually detained.

On April 6, 2022, he was arraigned at the Ogba Magistrate’s Court by the police who charged him with the offence of threat to life and was thereafter remanded in prison custody.

According to the details of the incident announced by the Headfort Foundation (Prison Reform Initiative), a foundation that usually visits prisons and courts in Lagos State on its Twitter handle on Thursday, he continued to stay in detention from April.

However, when the foundation visited the prison, one of the warders narrated the man’s plight to a lawyer from the foundation and how the man’s lawyer stopped defending him due to inability of the man to pay for his services.

The lawyer of the foundation was said to have taken up the matter and started representing him in court while the case suffered many adjournments because the police no longer bothered to appear in court.

So on September 13, the lawyer prayed the court to dismiss the case for want of diligent prosecution because there was no proof against him.

The court granted the application, discharged and acquitted the man after spending five months in prison custody.
